The sky is falling! - FileFront News

This News Item has been viewed 347,545 times
Recently I began removing illegal content from the networks. My purposes were twofold: to keep FileFront from being shut down, and to become wildly unpopular within the network community. Mission accomplished! That's right, don't be too hard on the network staff; they were just following orders. I'm the evil puppet master here, thank you very much! And now, I'll answer questions from the audience.

No one cares, why are you being such a bunch of jerks?

SILENCE PEON. Er, what I meant to say is that people do care. Trust me, I hear from them every day! And contrary to popular opinion, it's not always a faceless corporation siccing their lawyers on us; I receive dozens of messages every week from independent artists, writers, composers, and other creative types, asking me to respect their copyright by removing infringing files. For many of them this is their livelihood, and they really can't afford to have us bootlegging their work because it's “no big deal.”

Those files have been here for weeks/months/years. Why did you wait so long to remove them?

Because I didn't know they were there. I assumed that the people running things before I showed up were monitoring the network for illegal content, but apparently this was not the case. But the law doesn't care how long something has been on our site - once it's discovered it has to go. So now that I know these files are here, I am obligated to remove them. It's not a matter of personal opinion, or whether I like or dislike the files I remove - it's the law!

You're all hypocrites because I found this one file with copyrighted content in it!

Actually we're all human. We can't be everywhere at once, and I guarantee there will always be files we miss. Why else would we have systems in place that allow users to report inappropriate content? What matters is that at the end of the day we can honestly say we did our best to play by the rules.

On that note, I'd like you all to take a look at this article about a recent lawsuit brought against Veoh, another content sharing site on the net:

Of particular import is the idea that while it's understood we won't have a site that's 100% free of infringing content, we do have to actively police what's on our servers.

So what constitutes a violation anyway? It's totally unclear!

Well, your first stop is the user agreement for FileFront:

Check the part titled 'Copyright Policy' at the end. There's also a file upload page that elaborates on some of those points here:

Copyright can be tricky; I've been working with copyright issues for years now and I still don't know all the ins and outs. One thing I can say definitively though: it's up to the copyright holder. If someone slaps us with a cease-and-desist notice because somewhere there's a file with 5 seconds of their music in it, we'll remove the file. That's life unfortunately - if you want to use copyrighted content, even small clips, you have to be prepared for the possibility of the creator shutting you down.

That said, we have yet to receive a single takedown request for short clips, be they of music, tv shows, or even movies. Mods using sound effects from a movie/tv show/etc. are A-OK with us, as are fan-made music videos using clips from game cut scenes, shows, and the like. On the other hand, music copyright makes up the bulk of complaints we receive, so music mods which use copyrighted music are a big no-no. And let me just get this out of the way: don't be the smartass who uploads a bunch of music with the last 20 seconds cut off the end of each song. Don't be that guy. That guy sucks.

If after reading all this you're still not sure if the content you want to upload is ok, ask us! There's no guessing or worrying involved, just get in touch with the site you want to contribute to and tell them why you're uncertain. Remember, we're in this business because we want to make enormous piles of money. But in addition to the money (which I'm still waiting for... what's taking so long?), we also want to be a resource for the gaming community. And while I'm sorry that we can't accept every file submitted, without this oversight there wouldn't be a network in the first place. So please, do your part to keep our network clean!

correct me if i'm wrong but while not a standing rule but rather rule of thumb , i believe using 20 seconds or less of media (audio/video) is usually ''acceptable'' across the web .

This should clarify things nicely. Again, it's not our evil dictatorship, it's simply the current day climate on the internet. If any of you have questions, please do as Charlie says and ask!

That said, I'd like to thank everyone for understanding the necessity for this, and please, don't give in to the idea that the sky is falling.

So let me get it straight. Over time a bunch of people posted illegal content on filefront. Much of it has been taken down, but still some remain and will be removed. Am I correct?

For all the items people post by pressing the host file button on filefront, isn't there someone at the other end or or someone that has the job of checking all recent file submitted content? If so why have they not been checking this stuff more?

Has action been taken against those who posted the content? Has this just hurt filefront's reputation, or has it hurt it in other ways?

What is filefront going to do to prevent future illegal file posting? Meaning what precautions and is filefront going to do differently in the future?

From what I see, when they say "Illegal Content" they mean movie files with copyrighted music, sound mods with sounds ripped directly from major motion pictures, or, I'll pick on something I noticed on Halo Files, direct uploads of entire soundtracks. Just a little bit annoying to go out, buy a CD for $25, log onto Filefront and see the whole set uploaded onto the network.

(2nd Question) The Staff at FileFront usually do check every file that passes through their servers. However the staff don't know everything, if a staff member has no knowledge of the music, texture, model, animations etc in question then they can't determine whether it is legit or not. Therefore they must trust the Member who uploaded to be following the rules.
// End

Is a Member, who submitted the illegal file e-mailed that his/her content has been removed due to X, Y & Z reasons?

we do check every file however, in order to meet the demands of members wanting their files showing up onsite after being submitted in a good amount of time, we generally do not download and trial run every single file . if this were the case, it'd be a good day if you a member's submitted files were posted within a month . these are member's sites , nothing says any member who feels a mod may have copyright violations can't report it . there's 1 of us to every couple hundred (sometimes thousand) of you .

To #6: Are there really that many of us? I thought this was a small and scattered community spanning the globe. Or am I mistaken? I somehow doubt that there are thousands of us. As for the whole copyright thing, I say this: We live in the Information Age.

"Beware he who would deny you access to information, for in his heart, he dreams himself your master." -Brother Lal, Sid Meier's Alpha Centauri computer game

Just a thought.

P.S. Resistance is futile, eh?

Just for the BC guys, the FF Network Staff (when they post in these global announcements) appear on every network site. They do not see your posts unless they read this announcement at BCFiles.

The exact same FF Network Staff comments are showing up at the announcement on Legacy Files.

Like some customization community like FPSBanana, they place a skin license, map license like this:

Skin License

This Skin is free to download, but may not be free to modify or redistribute. Please respect the authors' wishes.

Like that.I think FileFront need to put this up.

I hope this Filefront network doesn't fall down.

I am not complaining or something,I just pointing several things out.

You're right. Someone is sitting in the other end checking the file. Unfortunally we don't always know that stuff is copyrighted.

It happens every now and then that we refuse a file, but in the end, as stated above we're just human.

I spend many hours a month writing emails to fileposters regarding content of their files in one way or another. But we can't catch everything in the first round.

Also becauce Copyright law is sometimes diffrent depending on the contry you come from.

If only copywrite laws were simpler...

And why do they have to be so bleeping harsh, anyway? It's like, you accidentally break them without even realizing it, and you get sued a million ways to Monday!

Great job, America. Once again, we've proved we can be complete jerks by throwing more lawsuits around than there are dollar bills.

Bah. I guess it's for reasons like this that we end up checking everything that comes across our desks over here are Jedi Knight Files.

Good going, Charlie and the team! I know it can make you unpopular in the short term, but I know that every one of the many thousands of users (is that right? yep, check out how many times some files have been downloaded!) appreciates the organized way you manage so many maps and mods, and if the way for us to keep on enjoying the benefits of File Front (and you to keep your job) is to give up some stuff that shouldn't have been there anyway, know that there are a lot of us that stand solidly behind you.

Say, what I'm reading kind of makes me hurt inside that you guys (and gals perhaps) are under a lot of pressure to do a job so may people obviously take for granted. When I read that page you referred to about the lawsuits it made me think of something. Just as there are beta testers for most mods and such, what about having a way that gamers could help with the in-depth checking part for complex uploads that could contain possible infringements (music, graphics and such)? You could still post the files at the same rate, but soon after ones up there zap your helpers an email or have a special page asking for a simple content-based review. A number of gamers like us who download these and mess with them for hours (hey, for us it's fun!) probably wouldn't mind taking a few extra minutes to give some feedback, especially if we felt that it was a contribution to the rest of the community. Up until now I never thought to say anything if I thought I recognized something or really don't know how I would do it. I think it would be good to handle outside the normal comment area, since the innocent sometimes get suspected and it would be nicer not to be embarrassed in a public forum!

A side benefit to encouraging downloaders to be on the lookout also could be to help guys out there who think piracy doesn't matter see that instead of being 'unpopular' those who stand up against it are heros! Honest dealing comes around to help us all in the end. Enough piracy, and the music, video and gaming industries are out of business! Really – “The worker is worthy of his wage”. If you want something, buy it. If you are getting something for free or it's something we all share, be a good citizen and at least pull your weight!

Let me quickly add, that although this does not fall under copyright laws - Dawn Of War Files will not upload any cheat software such as trainers to their servers, as this presents an unfair advantage to other players.

Copyright is complicated to discuss, but as a general rule - if you didn't make it and haven't got the owners permission, don't use it. If you don't know who made it, don't use it.

Good for you! I only use cheats on GTA:SA smile I will freely admit i can't get past a few missions so i get myself a jetpack or health armor and a quarter of a mil. I am a noob at GTA:SA and damn proud of it. Now BF2 on the other hand i will hunt down anybody who hacks or cheats. It might be fun to see 5000000000001 DPVs or boats at first but when the lag hits you scream like a baby.

I'm glad to hear that someone is doing this smile Violation of intellectual copyright laws is running rampant in this country and very few people (aside from the copyright holders) acknowledge this issue. Many people are ignorant to the rules while even more people just don't care. Two Thumbs Up!

I totally agree with redeemed74 (post #23).

If something could be implemented like what he's described, that would take a ton of work off your shoulders and make a much more thorough sweep of the site. Istead of just having a sheriff, employ a neighborhood watch type deal.

What's wrong with the kobmaru mod though, i know it got pulled, at least last i'd heard.

They i'd imagine have listed every credit, every mod, and for audio, theres really no way to get something like a phaser short of recording the sound....

Just a curiosity...

@#38: The charge for posting such files is you get branded a heatnen and a sinner and will go to hell where you will burn in the lake of fire forever and ever and ever. Endless torment. Oh, and you have to share a room with the telletubbies.

I cant belive it. some people are warning that they will remove there mods from the site due to this, but i say most modders when posting there mods on file front put this
''Permission must be sought from both ...... and ....... before modification and subsequent publication of the mod, texture sets and any other related file in the archive.
They can be uploaded in any site but credits MUST be given. ''
So have would they like it if some one did use there mod with out permission , They report it to file front and the file is removed, this should be the same with the music files.
So its about time. plus its easy to put your own music file in your bc on your PC. so theres no need to put them on bc file front is there.
thats all i got to say about that

@#29: I could...but copyright laws aren't the same around the world and because I only live in one country I have no idea the level of piracy that goes on in other countries. Therefore, what I said was correct. I suppose I should say that I live in the U.S. but I assume you assumed that....

I don't really understand the big move here other than the site probably started getting a lot of copyright infringement notices. Entire soundtracks for games being taken down is a no brainer but what else could need taken down? All of the mods here are for fun and not intended for sale. Or does the MPAA/RIAA see things differently??
hmmm.... 1 copyrighted song...20 second clip of it in a mod...downloaded 137 times..... why that is going to cost *holds pinky to lip* 1 hundred billion dollars stick out tongue
lol seriously though, the copyright law in this country is sad indeed.

I cant belive it. some people are warning that they will remove there mods from the site due to this
if i could please elaborate on this one thing quickly...
some modders in the BC Community are really considering pulling their mods from BCFiles not because of Filefront's policy, but because of some of the nasty and rude things that have been said about people recently posting their objections based upon their confusion in all this recent shake-up...
at first, there was confusion and maybe a little worry or objection, but that quickly subsided...
and then there were some people calling others' mods, that were pulled, "insignificant" and other rude comments about modders and their reconsideration as to where they may want their mods hosted...
and it absolutely does not help the issue at all when you have the LegacyFiles Site Manager IKS Yo Mama insulting BC modders and the BC Community by posting in a news item at BCFiles:
Amazing how this is the only community panicking on the network? Perhaps a bit of maturity is needed...stop panicking and grow up!
(that news item at BCFiles and all the comments was deleted yesterday)
he is a Site Manager and is supposed to be representing FileFront as a whole... i can only hope the rest of the Filefront Staff and Admins dont have this sort of attitude and sentiment to BC Modders and the BC Community... that is so very rude, arrogant, and condescending for a Site Manager to say about another community...
statements like this, and others that were posted by some other patrons, really upset alot of people who spend their own unpaid free time to make mods for everyone to enjoy and make everyone's gaming experience all the more awesome... but when you get some people posting rude things, and especially when one of them is a Filefront Staff member also, i can fully understand why some modders are now starting to consider to keep their past and future mods to their friends, people with respect and maturity, and sites like BCC and BCS and their patrons only, where there is no such rudeness or disrespect...
so whereas people blame and down-talk modders for pulling their mods and say they are "overreacting" and whatever else, it is actually the rudeness of others and at least one FileFront Staff member, that was shown at BCFiles the last few days, that pushes them to reconsider... and frankly, i cant say i blame those modders one bit for their reconsideration...
and that is why some modders are considering pulling their files from BCFiles...

The high interactivity of this site should be considered a luxury, not a right.

That sentence pretty much sums up this news clipping, and my thoughts for
everybody's whinning.I'm starting to think that people just ignore those rules >_>.

Basically, if the Network decides your file is no longer acceptable due to copyright
laws, or cause it doesn't represent the community in a pleasent way, then pucker
up and post your mod somewhere else. There's Fileplanet, modDB, plus a host of
other sites that will accept your mod, or not.

The amount of files this network hosts is staggering. If you ever look at the top,
right hand panel, you can see there are terrabytes of mods for BC alone. Not
counting other sites. Your not paying anything to have your file hosted here. Your
not paying anything to get the awesome (sometimes erradic) download speed you
get here.

There's no reason to complain other then to satisfy your personal ego. If you can't
bypass your ego and just live with it, then the moderators have the full right to just
remove you from this website. Don't make more trouble for the moderators and
network staff here, they already have other important stuff then dealing with some
bruised ego.

I think that JimmyB76 (post #46) had made a reasonable point about people getting offended. It's easy in the middle of a big issue to get steamed up and say things that were a bit out of line. I'm a father of 3 kids under 8 years old and more than once have broke my own rules of demeanor when dealing with a crisis. After things die down and I get my bearings back I try to make it up to them showing that "no one is above the law - even daddy!" But it doesn't mean that I can then be disrespected or disregarded!

In the issue at hand, I think the FileFront staff have made a bold step forward and resolved some issues they should be applauded for. In doing it they did have to deal with a number of attitude issues that I'm sure were not pleasant. The staff member who gave the 'offending' statement may well have had good reason to for the people it was directed for, but obviously others reading it took it personally (his wording was too general.) I think that FileFront has dealt properly with the issue by removing the post and preventing further unintended offence. Now that it has turned up on this page I think it is only appropriate that it be brought into perspective with the overall issue at hand. No other modders than the ones who were freaking out BEFORE the post really needed to take it personally anyway as it wasn't directed to them, but it is good that it is gone to avoid any more problems. So in the end I applaud FileFront for their dealings in both attacking piracy at its core and removing offending posts!

But I think FileFront has dealt reasonably with this issue by removing the offending statement

At the end of the day there really arent two sides to the copyright coin. You either agree to copyright, and play by it's rules, or, you disregard copyright and get labelled a moron. We do make a point of checking files as we approve them, but as others have said we can miss things. Seriously when you get a skin that looks like a five year old has attacked it with paintbucket it can be difficult to tell if the author has stolen it.

That'd be more in the line of "plagiarism", rather than copyrights.

Every single site on this network should have policies against plagiarism already; if not, I'd recommend that as the next thing for Charlie to mull over.
